These Terms and Conditions ("Terms") govern your use of the Whyknot online store and any purchase you make through it. By browsing this site or placing an order, you agree to these Terms. Please read them carefully.

1. Who we are

This store is operated by Whyknot ("we," "us," "our"), a sole proprietorship based in Georgia, United States. You can reach us at getwhyknot@gmail.com.

2. Eligibility

You must be at least 18 years old, or the age of majority where you live, to place an order. By ordering you confirm you meet that requirement and that the payment method you use is yours or that you have permission to use it.

3. Products, colors, and availability

We work hard to describe and photograph our products accurately, but we can't guarantee your screen displays colors exactly as they appear in person. Slight variation in color, finish, and materials is normal, particularly for beauty tools and devices and for natural materials like jade and stone.

All products are subject to availability. We may change or discontinue any product at any time without notice, and we may limit order quantities.

4. Pricing and errors

All prices are in U.S. dollars and do not include shipping or applicable taxes, which are calculated at checkout. We may change prices at any time, but a change won't affect an order we've already accepted.

Despite our efforts, a product may occasionally be listed at an incorrect price or with incorrect information. If an item's correct price is higher than the listed price, we'll contact you before shipping to ask whether you want to proceed at the correct price or cancel for a full refund. We reserve the right to correct errors and to cancel orders placed at an incorrect price.

5. Orders and acceptance

Your order is an offer to buy. Our order confirmation email acknowledges receipt but does not constitute acceptance. We accept your order when we send it for fulfillment.

We reserve the right to refuse or cancel any order, including where we suspect fraud, an unauthorized payment method, a pricing error, or a violation of these Terms. If we cancel an order you've paid for, we'll refund you in full.

6. Payment

Payment is processed by Shopify and its payment partners. We don't store your full card details. You agree to provide current, complete, and accurate purchase and account information.

7. Shipping, delivery, and risk of loss

We ship within the United States only. Standard U.S. shipping is $5.99, and shipping is free on U.S. orders of $50 or more. Delivery estimates are estimates, not guarantees. Most U.S. orders arrive within 5–10 business days after being placed, including 1–2 business days of processing — see our Shipping Policy for full details.

Risk of loss passes to you on delivery to the carrier, subject to the lost-package protections described in our Shipping Policy.

8. Returns and refunds

Returns are governed by our Return and Refund Policy, which forms part of these Terms.

9. Hygiene and product use

Our products are personal-care tools used on the skin, scalp, face, and feet. You are responsible for using each item as intended and for following any instructions or safety guidance included with it. If you have a medical condition or sensitivity, check with a healthcare professional before use. These products are not medical devices and are not intended to diagnose, treat, or cure any condition.

10. Intellectual property

All content on this site - text, graphics, logos, product photography, and layout - is owned by us or our suppliers and licensors and is protected by intellectual property law. You may not copy, reproduce, republish, or use it commercially without our written permission.

11. Acceptable use

You agree not to use this site for any unlawful purpose, to attempt to gain unauthorized access to our systems, to interfere with its operation, to scrape or harvest data, or to place fraudulent orders.

12. Reviews and submissions

If you submit a review, photo, comment, or other content, you grant us a non-exclusive, royalty-free right to use, reproduce, and display it in connection with our business. You're responsible for what you submit, and it must be your own honest opinion and not violate anyone else's rights. We may remove content at our discretion, but we will not edit a review to change its meaning or publish reviews that aren't from real customers.

13. Third-party links

Our site may link to third-party websites we don't control. We're not responsible for their content, policies, or practices, and a link is not an endorsement.

14. Disclaimer of warranties

Except where prohibited by law, this site and our products are provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability and fitness for a particular purpose. We don't warrant that the site will be uninterrupted, secure, or error-free.

Nothing in these Terms limits any warranty or right you have under applicable consumer protection law that cannot be waived.

15. Limitation of liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of this site or any product purchased from us. Our total liability for any claim will not exceed the amount you paid for the product giving rise to that claim.

16. Indemnification

You agree to indemnify and hold us harmless from any claim or demand, including reasonable legal fees, arising from your breach of these Terms or your violation of any law or third-party right.

17. Force majeure

We're not liable for delays or failures caused by events beyond our reasonable control, including carrier disruptions, customs delays, supplier failures, natural disasters, and government action.

18. Governing law

These Terms are governed by the laws of the State of Georgia and the United States, without regard to conflict-of-law principles. Any dispute will be brought in the state or federal courts located in Georgia, and you consent to their jurisdiction.

19. Severability

If any provision of these Terms is found unenforceable, that provision will be limited or removed to the minimum extent necessary and the remaining provisions will stay in full force.

20. Changes to these Terms

We may update these Terms at any time. The revised version takes effect when posted, and the "last updated" date above will change. Your continued use of the site after a change means you accept it.
